Rebecca Hoberg is a litigator with nearly 15 years of experience representing individuals and companies of all sizes in a wide-range of legal matters.

Rebecca has successfully litigated a variety of complex business disputes and real property matters, including: breach of contract, intellectual property, trade secrets misappropriation, unfair competition, financial services fraud, breach of fiduciary duty, professional negligence, real estate fraud, real property, constitutional takings, products liability, failure to warn, wrongful termination and pay-equity claims, FEHA and ADA claims, environmental liability, bankruptcy, creditor’s claims, and constitutional torts. She has represented and advised various public entities in civil litigation, code-enforcement, and public law matters. She has also conducted large-scale corporate investigations.

Rebecca has extensive experience in both federal and state courts, before administrative agencies and self-regulatory bodies, and before various arbitral bodies including the AAA, JAMS, and FINRA.

With nearly 15 years of litigation experience under her belt, Rebecca brings fierce advocacy, keen strategic instincts, and excellent judgment to all of her matters; and she has somehow managed to keep her sense of humor. She listens intently to the needs of her clients, and provides sound legal advice to effectively achieve their goals and objectives.

Rebecca spends her free time running ultramarathons through the beautiful trails of the East Bay and Marin.

Representative Matters

  • Conducted large-scale internal investigations of stock option compensation practices of technology and Fortune 500 companies. Developed and implemented investigation strategy; managed collection, review, and analysis of electronic and hard copy data; conducted executive and employee interviews; analyzed legal and accounting implications of factual findings; prepared audit committee presentations setting forth findings and legal advice.

  • Successfully challenged California state regulation denying elderly adults meaningful access to licensed care facilities for mental health treatment; litigation brought under the Fair Employment and Housing Act, Federal Housing Amendments Act, Americans with Disabilities Act, and other federal and state statutes. Case ultimately resulted in amendments to the challenged regulation, and litigation team was awarded the Silicon Valley Public Interest Law Firm’s “Public Interest Counsel Award” for its work.

  • Developed and implemented international litigation strategy on behalf of technology company seeking to recover for fraud and breach of contract against foreign distributor; initiated and managed claims before the American Arbitration Association, California Superior Court, and Singapore district court. Developed and implemented company-wide investigation relating to counterclaims alleging defamation, securities fraud, and antitrust violations. Conducted employee and executive interviews. Coordinated large-scale document collection and review. Participated in all aspects of arbitration. Led and managed team of junior associates and foreign counsel.

  • First-chaired trial of $10 million dollar real estate fraud claim in Santa Clara Superior Court; successfully obtained nonsuit and defense judgment after plaintiff completed case-in- chief.

  • Successfully obtained dismissal on demurrer of CERCLA contribution action before the U.S. District Court for the Central District of California, and summary judgment on all claims in CERCLA action before the U.S. District Court for the Northern District of California.

  • Successfully negotiated favorable settlements relating to claims of alleged state- wide contamination of drinking water wells in California and New York.

  • Successfully represented California dairy companies in challenge to multi- million-dollar regulatory fine issued by California Water Quality Control Board relating to salinity levels in discharge water.

  • Represented broker-dealer clients in Financial Industry Regulatory Authority (formerly NASD) arbitrations.
